Terms and Conditions

1. Definitions
1.1. Online Store – the online store located at gymstar.store.
1.2. Account – a personal account created for the Buyer when registering in the Online Store.
1.3. Seller – MB MGK prekyba, a legal entity registered in the Republic of Lithuania, legal entity code: 306669684, registered office: Vaižganto g. 11D-10, Kaunas, Lithuania, LT-44225. Data about the Seller is collected and stored in the Register of Legal Entities, managed by the state enterprise Centre of Registers.
1.4. Buyer –
-
a person of legal age whose legal capacity is not restricted by court, or
-
a minor between 14 and 18 years old with parental/guardian consent (unless emancipated), or
-
a legal entity.
1.5. Product(s) – goods sold in the Online Store.
1.6. Privacy Policy – a document intended to provide the Buyer (a natural person) with information on the purposes, scope, and security of personal data processing, as well as other legally required information about the processing of the Buyer’s personal data.
1.7. Terms – these Terms and Conditions of sale of goods in the Online Store gymstar.store, which apply to every purchase made by the Buyer and to every Agreement concluded between the Buyer and Seller.
1.8. Agreement – a contract concluded between the Buyer and the Seller regarding the purchase of Products in the Online Store, consisting of the Buyer’s product order request submitted in the Online Store and these Terms.
2. General Provisions
2.1. These Terms, together with the documents referred to herein, provide the Buyer with information about the Seller and set out the conditions for the sale of Products in the Online Store.
2.2. The Terms are mandatory when concluding Agreements between the Buyer and Seller.
2.3. Before completing an order, the Buyer must read and agree to the Terms (by ticking the box “I have read and agree to the Terms”). Confirmed Terms form a legally binding part of the Agreement and establish the rights and obligations of the Buyer and Seller, product purchase and payment conditions, delivery and return procedures, liability of the parties, and other sales-related provisions.
2.4. Before completing an order, the Buyer must also read the Privacy Policy.
2.5. If the Buyer refuses to read or agree to the Terms or Privacy Policy, the Buyer cannot complete an order or conclude an Agreement.
2.6. The Online Store is a retail store intended for Buyers purchasing for final consumption purposes.
3. Ordering Products and Conclusion of the Agreement
3.1. The Buyer may order Products in the Online Store in two ways:

without registration,
-
by registering (creating an Account).
3.2. To order Products, the Buyer must log in to the Account or use the guest checkout option and fill in the required information fields for proper order fulfillment.
3.3. Only persons specified in Clause 1.4 may place orders. By agreeing to the Terms, the Buyer confirms eligibility to purchase Products.
3.4. The ordering system allows the Buyer to review and correct mistakes before placing the order. After filling the cart and completing all steps, the Buyer clicks “Order and Pay”. Submitting the order creates an obligation to pay as specified in Clause 5.6.
3.5. The Agreement is concluded once the Buyer submits the order, pays for it, and receives an email confirmation from the Seller that payment was received.
3.6. If the Seller cannot fulfill the order (e.g., product unavailable, stock shortage, pricing error), the Buyer will be informed promptly. The order is canceled and the Buyer is refunded within 14 days.
3.7. Once Products are dispatched, the Seller notifies the Buyer by email.
3.8. The Seller reserves the right to process only those orders that include correct and accurate data (delivery address, phone number, email, etc.).
3.9. The Buyer can view purchase history by logging into the Account.
3.10. By concluding the Agreement, the Buyer agrees that purchase documents (invoices, warranty documents, if applicable) may be provided physically with the Products or electronically via the Buyer’s email.
3.11. By agreeing to the Terms, the Buyer confirms that they do not require a separate paper copy of the Terms, unless otherwise agreed.
4. Rights, Obligations, and Liability
Buyer’s rights:

Purchase Products according to these Terms.

Cancel the Agreement and return Products as provided by law and these Terms.
Buyer’s obligations:
-
Pay for and accept the ordered Products.

Provide accurate order details and update them if changed.
-
Use the Online Store lawfully and fairly.
-
Keep login details confidential.
-
Comply with the Terms and applicable law.
Seller’s rights:
-
Modify these Terms, store functions, product offerings, and prices.
-
Restrict or suspend access or cancel the Buyer’s Account if Terms are violated.
-
Launch or cancel promotions, adjust prices, or update store content at any time (without affecting prior Agreements).
Seller’s obligations:
-
Make every effort to fulfill orders properly and on time.
-
Provide Buyers with necessary information.
-
Comply with the Terms.
-
Offer a similar replacement if an ordered Product is unavailable.
Liability:
-
The Buyer is responsible for actions performed via the Account and accuracy of provided data.

Products are sold for personal/household use. The Seller is not liable for business-related losses, profit loss, or business interruption.
5. Prices and Payment
5.1. Prices are shown in euros including VAT.
5.2. The price applicable is the one valid at the time of order submission.
5.3. Prices exclude delivery costs (available under the “Delivery” section).
5.4. The total price, including all charges, is shown during order submission.
5.5. The Seller may correct product prices after order submission if errors occurred due to system faults or obvious mistakes. The Buyer will be informed and may confirm or cancel the order. If canceled, payment is refunded within 14 days.
5.6. Payment is made at the time of order via electronic banking through UAB “Paysera LT”.
5.7. Advance payment is required. The Seller is not responsible for banking/payment execution errors.
5.9. Delivery time starts once the Seller confirms receipt of the order.
6. Delivery

Delivery is available throughout Europe.

Options: courier delivery or parcel terminals.

Orders over €65 are delivered free of charge in Lithuania.
- Orders over €150 are delivered free of charge in other European countries.

Standard delivery time: within 5 business days (maximum 30 days for consumers).

Buyer must provide accurate delivery details.

Buyer assumes responsibility if parcel codes are shared with others.

Buyer must inspect parcel upon delivery. Damaged parcels may be refused with a written report.

Claims regarding visible product defects must be submitted within 5 days of delivery.
7. Right of Withdrawal

Consumers may cancel the Agreement within 14 days of receiving the product without giving a reason.

The Buyer must notify the Seller by email: info@gymstar.lt.

A sample withdrawal form is provided but not mandatory.

Refunds are made within 14 days of withdrawal notice, excluding delivery fees.

Refunds are withheld until the product is returned or proof of return is provided.

Return shipping costs are borne by the Buyer.
8. Product Quality and Warranty

Product descriptions are provided in the Online Store.

The Seller guarantees product quality as required by law.
-
Some products may have commercial warranties as specified in their descriptions.

Product images are for illustration; actual colors or packaging may differ.

Defective products can be returned in accordance with law and these Terms.

Consumer rights:

Replace defective products.
-
Request price reduction.
-
Cancel Agreement and get a refund.
-

Seller responds to quality complaints within 14 days.
-
Refunds for defective products are made within 14 days after receipt.

Return costs for defective products are covered by the Seller.
10. Force Majeure
The Seller is not liable for delays or non-performance caused by events beyond its control. Obligations are suspended during such events. The Buyer will be informed and delivery dates adjusted accordingly.
11. Final Provisions

Notices are sent to the Buyer via email or phone provided in the Account/order.

The Seller may update these Terms. The Terms in force at order submission apply.

Lithuanian law governs the Agreement.
-
Buyer complaints may be submitted to the Seller via info@gymstar.lt. Responses are given within 14 days.
-
If the Buyer disagrees with the Seller’s reply, they may apply to the State Consumer Rights Protection Authority.
